El Poder Judicial y la Universidad Privada San Juan Bautista (UPSJB) firmar=
on el 20 de febrero de 2017, un Convenio de Cooperaci=C3=B3n Interinstituci=
onal mediante el cual, la referida universidad "se compromete a otorgar des=
cuentos especiales a los Magistrados y auxiliares jurisdiccionales, as=C3=
=AD como tambi=C3=A9n a los familiares directos de estos (c=C3=B3nyuges e h=
ijos) =E2=80=A6" =C2=BFQu=C3=A9 tal? =

=C2=BFAcaso el Poder Judicial no deber=C3=ADa ser totalmente aut=C3=B3nomo =
e independiente? =C2=BFQu=C3=A9 pasar=C3=ADa si alg=C3=BAn funcionario de l=
a universidad comete alg=C3=BAn delito y es denunciado ante el Poder Judici=
al? =C2=BFAcaso el juez y / o auxiliares jurisdiccionales encargados de imp=
artir justicia no estar=C3=ADan frente a un caso flagrante de conflicto de =
intereses? =C2=BFC=C3=B3mo juzgar a un funcionario universitario denunciado=
 por alg=C3=BAn delito, si los jueces y / o auxiliares jurisdiccionales, y =
sus c=C3=B3nyuges e hijos estudian en la referida universidad=E2=80=A6 en c=
ondiciones econ=C3=B3micas particularmente ventajosas? =

=C2=BFQu=C3=A9 pasar=C3=ADa =E2=80=93 por ejemplo =E2=80=93 si el principal=
 accionista de la UPSJB, presentara una querella por difamaci=C3=B3n contra=
 un columnista de un medio period=C3=ADstico, por opinar cr=C3=ADticamente =
respecto de la referida universidad o de su persona? =C2=BFAcaso no habr=C3=
=ADa conflicto de intereses, que los jueces y / o auxiliares jurisdiccional=
es que fallen contra el querellado, est=C3=A9n ellos =E2=80=93 o sus famili=
ares =E2=80=93 estudiando o ense=C3=B1ando en la universidad de propiedad d=
el querellante? =

Pues bien, eso que pod=C3=ADa suceder=E2=80=A6 sucedi=C3=B3. El querellado =
referido en el p=C3=A1rrafo anterior, fui yo. Y el querellante, el Congresi=
sta Jos=C3=A9 Luis El=C3=ADas =C3=81valos, principal accionista de la UPSJB=
. Y todo porque a mediados de 2018 escrib=C3=AD un art=C3=ADculo de opini=
=C3=B3n en Lampadia =E2=80=93 y en el Diario Correo de Ica =E2=80=93 titula=
do "Las Almas Mater de la Corrupci=C3=B3n en el Estado Peruano", d=C3=B3nde=
 precisamente, me refer=C3=AD a aquellas universidades, como la UPSJB de Jo=
s=C3=A9 Luis El=C3=ADas =C3=81valos, la C=C3=A9sar Vallejo de C=C3=A9sar Ac=
u=C3=B1a, la Alas Peruanas de Joaqu=C3=ADn Ram=C3=ADrez, la Garcilaso de la=
 Vega de Luis Cervantes Li=C3=B1=C3=A1n, la Telesup de Pepe Luna G=C3=A1lve=
z, entre otras que, en mi opini=C3=B3n, no son nada santas. En todo caso, s=
e trata de universidades de propiedad de cuestionados pol=C3=ADticos en act=
ividad, las cuales acogen en sus aulas =E2=80=93 en condiciones econ=C3=B3m=
icas ventajosas =E2=80=93 a muchos jueces y auxiliares jurisdiccionales, a =
sus familiares e hijos, y a muchas autoridades estatales. =C2=A1Un descaro =
moral! =

Pregunto =C2=BFacaso los jueces que fallaron en mi contra actuaron con inde=
pendencia y autonom=C3=ADa? Claramente, NO. =C2=BFAcaso el Congresista El=
=C3=ADas =C3=81valos =E2=80=93 repito, due=C3=B1o de la UPSJB, donde estudi=
an jueces y auxiliares jurisdiccionales, y sus familiares (esposas e hijos)=
 en condiciones econ=C3=B3micas ventajosas =E2=80=93 no tiene influencia so=
bre los magistrados del Poder Judicial que fallaron en mi contra? Clarament=
e, SI. =

Es verdad; el fallo en mi contra redujo la reparaci=C3=B3n civil de S/, 8=
=E2=80=99000,000 solicitada por el querellante a S/. 20,000; o sea, a apena=
s el 0.25% del monto solicitado. Pero el problema es el fallo; no el monto =
de la reparaci=C3=B3n civil. El hecho es que el due=C3=B1o de una universid=
ad me querell=C3=B3 por difamaci=C3=B3n, por un art=C3=ADculo period=C3=ADs=
tico que refleja mi opini=C3=B3n sincera respecto de un grupo de universida=
des peruanas de p=C3=A9sima calidad. Y el Poder Judicial que fall=C3=B3 en =
mi contra, claramente est=C3=A1 comprometido con dicha universidad, a trav=
=C3=A9s de un Convenio de Cooperaci=C3=B3n Interinstitucional, que le quita=
 independencia y autonom=C3=ADa. =

=C2=A1Qu=C3=A9 problema! Tengo la mejor impresi=C3=B3n de la Dra. Elvia Bar=
rios, presidenta del Poder Judicial y de la Corte Suprema de Justicia de nu=
estro pa=C3=ADs, y de un n=C3=BAmero =E2=80=93 no menor =E2=80=93 de jueces=
 y fiscales probos y valientes. Pero s=C3=AD quisiera que se sepa p=C3=BAbl=
icamente que este tipo de convenios existen, y que es menester corregir est=
a mala pr=C3=A1ctica generalizada en el mundo acad=C3=A9mico =E2=80=93 univ=
ersitario de nuestro pa=C3=ADs. =

El Poder Judicial =E2=80=93 por definici=C3=B3n =E2=80=93 debe ser independ=
iente y aut=C3=B3nomo. Y para ser independiente y aut=C3=B3nomo, no debe de=
berle favores a nadie=E2=80=A6 y menos a universidades y / o pol=C3=ADticos=
 de conductas chuecas. Suscribir convenios como el referido en el presente =
art=C3=ADculo, es como firmar Convenios de Cooperaci=C3=B3n Interinstitucio=
nal=E2=80=A6 para delinquir impunemente. Y eso me parece mal=E2=80=A6 muy m=
al. =

=ADas =C3=81valos, principal accionista de la UPSJB. Y todo porque a mediad=
os de 2018 escrib=C3=AD un art=C3=ADculo de opini=C3=B3n en Lampadia =E2=80=
=93 y en el Diario Correo de Ica =E2=80=93 titulado "Las Almas Mater de la =
Corrupci=C3=B3n en el Estado Peruano", d=C3=B3nde precisamente, me refer=C3=
=AD a aquellas universidades, como la UPSJB de Jos=C3=A9 Luis El=C3=ADas =
=C3=81valos, la C=C3=A9sar Vallejo de C=C3=A9sar Acu=C3=B1a, la Alas Peruan=
as de Joaqu=C3=ADn Ram=C3=ADrez, la Garcilaso de la Vega de Luis Cervantes =
Li=C3=B1=C3=A1n, la Telesup de Pepe Luna G=C3=A1lvez, entre otras que, en m=
i opini=C3=B3n, no son nada santas. En todo caso, se trata de universidades=
 de propiedad de cuestionados pol=C3=ADticos en actividad, las cuales acoge=
n en sus aulas =E2=80=93 en condiciones econ=C3=B3micas ventajosas =E2=80=
=93 a muchos jueces y auxiliares jurisdiccionales, a sus familiares e hijos=
, y a muchas autoridades estatales. =C2=A1Un descaro moral!=C2=A0</span></p=

do. Pero el problema es el fallo; no el monto de la reparaci=C3=B3n civil. =
El hecho es que el due=C3=B1o de una universidad me querell=C3=B3 por difam=
aci=C3=B3n, por un art=C3=ADculo period=C3=ADstico que refleja mi opini=C3=
=B3n sincera respecto de un grupo de universidades peruanas de p=C3=A9sima =
calidad. Y el Poder Judicial que fall=C3=B3 en mi contra, claramente est=C3=
=A1 comprometido con dicha universidad, a trav=C3=A9s de un Convenio de Coo=
